Law enforcement officers must immediately suspend the driver's license of anyone arrested for DWI, refusing a breath test, or (for those under 21) operating a vehicle with a BAC of 0.01% to 0.08%

Officers must confiscate the license on the spot and forward it to the Chief Administrator of the Motor Vehicle Commission along with a suspension notice and report

Drivers have 10 days to request an administrative hearing to contest the suspension, which must be held within 10 days of the request

An administrative law judge must find clear and convincing evidence that the traffic stop had a factual basis and the DWI charge was proper for the suspension to continue pending municipal court adjudication

Time spent under preliminary suspension counts toward any final suspension imposed by the municipal court
