Excess federal Community Care Waiver reimbursements received beyond what was anticipated in the annual appropriations act must first offset any deficits in contracts between the Division of Developmental Disabilities and community provider agencies.

Remaining excess federal funds would be deposited into a newly established nonlapsing "Developmental Disabilities Community Infrastructure Fund" within the Department of Human Services.

One-time grants from the fund would support persons with developmental disabilities living in or seeking to live in community settings, with priority given to facility/infrastructure repairs, accessibility equipment, and assistive technology.

The Director of the Division of Developmental Disabilities must establish eligibility criteria and application procedures for grants, and submit annual reports on expenditures to the Senate and Assembly human services committees.
