New crematories cannot be constructed within 1,000 feet of public or private schools, residential zones, or recreational areas including parks, playgrounds, beaches, waterfronts, and conservation areas.

The New Jersey Cemetery Board is prohibited from approving crematory construction applications that fail to meet the 1,000-foot distance requirement.

The law takes effect immediately upon enactment and applies retroactively to January 1, 2025.

Existing requirements remain unchanged: crematories must still be located on dedicated cemetery property, with an exception for crematories operated in conjunction with funeral homes.
