Cooperative purchasing agreements for public works construction services may only be used if the contract is awarded by a New Jersey contracting unit and competitively bid in compliance with all applicable public bidding, bid security, performance guarantee, and insurance requirements.

Time-and-materials contracts through cooperative purchasing agreements are prohibited for public works projects subject to the Public Works Contractor Registration Act and the New Jersey Prevailing Wage Act.

Contracting units awarding public works construction contracts through cooperative purchasing agreements must verify and maintain records of contractor contact information, including principal business address and agent for service of process in New Jersey.

Contracting units may award indefinite delivery, indefinite quantity contracts for goods, services, or public works without final project plans and specifications, provided the bid advertisement promotes competitive bidding and specifies the purchase order process.

Affected contracting units include counties, municipalities, school districts, fire districts, State colleges and universities, county colleges, public research universities, and NJ Transit Corporation.
