School districts and county vocational school districts must adopt anti-nepotism policies as a condition of receiving State aid, with charter schools also required to implement such policies.

Relatives of school board members, chief school administrators, school business administrators, school board attorneys, and directors of personnel are prohibited from being hired, unless already employed before the policy takes effect or approved by the executive county superintendent after demonstrating the candidate is the only qualified person available.

District administrators and school board attorneys are prohibited from supervising relatives, and those with relatives in bargaining units cannot participate in collective bargaining negotiations or vote on agreements with that unit.

If a school board member or administrator resigns and their relative is hired within three months, the former official is barred from district employment for 12 months from their last date of service.

Per diem substitutes and student employees may be excluded from the anti-nepotism policy; the law takes effect 60 days after enactment.
