School districts receiving preschool education aid under New Jersey's School Funding Reform Act of 2008 must provide at least 50 percent of preschool pupil placements at licensed child care provider programs.

Remaining preschool placements (up to 50 percent) may be provided through district programs and Head Start programs.

School districts can apply for a waiver from the Department of Education if insufficient placements are available at licensed child care providers within the district.

Districts requesting waivers must submit justification information as specified by the Department of Education.

The act takes effect in the first full school year following enactment.
