Mandates motor vehicle history checks in addition to criminal background checks for community agency employees, agency heads, and community care residence applicants, alternates, and household members under contract with or licensed by the New Jersey Department of Human Services.

Adds disqualifying motor vehicle offenses including operating under the influence of alcohol or drugs, reckless or careless driving, and license suspension due to point accumulation or multiple offenses within the previous 10 years.

Requires background checks to be conducted at least every two years, with records obtained from the FBI, State Bureau of Identification, New Jersey Motor Vehicle Commission, and out-of-state equivalents.

Allows individuals to challenge disqualification by demonstrating clear and convincing evidence of rehabilitation to the Department of Human Services, which must issue a determination within 60 days.

Permits provisional employment for up to six months pending background check completion, provided the individual submits a sworn statement attesting to no disqualifying convictions.
