Health club facilities must notify members by mail or electronically of any change in ownership and the date of the transfer before it occurs.

Health club service contracts cannot be assigned to a new owner without written consent from the member, which may be provided electronically.

If the new owner fails to obtain written consent from a member within 30 days of the ownership change, the contract is automatically canceled unless the member later consents.

The consent request must be sent separately from the original contract and provided in advance of any ownership transfer.

This bill amends P.L.1987, c.238 and applies to health club services contracts entered into on or after the effective date.
