Data center owners and operators in New Jersey must submit semi-annual water and energy usage reports to the Board of Public Utilities, with existing data centers having 3 months to file their first report and new centers having 6 months.

Reports must include basic facility information, total energy consumption in kilowatt hours, water usage in cubic meters, water sources, on-site power supplies including backup generators, and details on electric utility service agreements.

Data centers receiving state financial incentives must also report additional performance metrics including power usage effectiveness, water usage effectiveness, renewable energy factor, and energy reuse factor.

The BPU must publish basic water and energy usage information on its website within 30 days of receipt, though performance and sustainability metrics remain confidential and can only be disclosed as anonymized, aggregated data from at least five facilities.

The reporting requirement applies for three years from each data center's first report submission, after which the BPU will determine whether to make the requirement permanent through formal rulemaking.
