Establishes a State contract set-aside program for "union business enterprises," defined as businesses with a union workforce, principal place of business in New Jersey, apprenticeship programs, and documented good faith efforts to maintain a diverse workforce.

Sets a goal requiring State contracting agencies to award at least 22 percent of their contracts to union business enterprises, either through direct prime contracts or subcontracting requirements.

Directs the Department of the Treasury to administer the program, maintain lists of qualified union business enterprises, and establish procedures for businesses to request inclusion and for third parties to challenge designations.

Requires each contracting agency to develop an annual plan for achieving the set-aside goal and submit annual reports to the department on contract awards, types of businesses receiving awards, and promotional efforts.

Imposes penalties on businesses that fraudulently obtain union business enterprise status, including reimbursement of cost differences, fines up to 10 percent of the contract amount, and ineligibility to transact State business for 3 to 24 months.
