New Jersey counties would be authorized to impose a county-wide infrastructure construction fee after obtaining approval from more than 50% of voters in a general or special election.

Fee proceeds must be used solely for public infrastructure projects within the county, including highways, bridges, utilities, and water and sewer systems.

The public question submitted to voters must state the maximum fee amount and may specify the implementation period and specific projects to be funded.

County governing bodies would administer fee collection and allocation in consultation with the State Treasurer and Commissioner of Community Affairs.

Voter-approved infrastructure fee amounts would be exempt from the existing 2.5% county tax levy cap, following the model of 14 other states including California, Florida, and Illinois.
