Pharmacy benefits managers (PBMs) are prohibited from requiring covered persons to use mail service pharmacies or automatically enrolling them in mail service pharmacy programs

The prohibition applies to PBM contracts with private health insurers, prescription benefit plans, and New Jersey's State Health Benefits Program and School Employees' Health Benefits Program

PBMs may still offer mail service pharmacy benefits, but only if covered persons are given the choice between mail service and non-mail service pharmacies and provide written consent

The legislation takes effect January 1, 2027

Supplements existing PBM regulations under P.L.2015, c.179 (C.17B:27F-1 et seq.)
