Businesses using artificial intelligence systems to communicate with consumers on online platforms must disclose AI involvement at the start of contact, before any further communication occurs.

Consumers must be provided with clear instructions on how to reach a human, including contact information, availability hours, and any other necessary details.

Violations constitute unlawful practices under New Jersey's consumer fraud act (P.L.1960, c.39), with penalties up to $10,000 for first offenses and $20,000 for subsequent offenses.

The Attorney General may issue cease and desist orders, and injured consumers may receive treble damages, punitive damages, and costs.

The bill takes effect immediately upon enactment.
