Boards of education in New Jersey must directly employ all personnel requiring State Board of Examiners certification, with exceptions for substitute teachers, dual enrollment faculty, shared services personnel, and charter management organization staff.

School districts may contract for specific services including child study team evaluations, home instruction, speech-language services when unable to hire sufficient staff, and related services through approved private clinics, licensed practitioners, or certified agencies.

Charter schools and renaissance school projects may apply to the Commissioner of Education for exemptions to directly employ school nursing services personnel on a case-by-case basis.

Instructional services must be delivered in-person unless the Commissioner of Education approves virtual or remote instruction for individual students or classes when equivalent in-person instruction cannot be provided.

Virtual or remote instruction is permitted without Commissioner approval for financial literacy graduation requirements, individualized student learning opportunities (independent study, internships, credit recovery), and charter/renaissance school summer sessions.
