New Jersey Board of Nursing must defer or withhold homemaker-home health aide certification when notified of a law enforcement charge alleging abuse, neglect, or violence against a patient by the applicant or certified aide

Certification must also be deferred or withheld when the board receives credible evidence of abuse, neglect, or violence against a patient, if the board determines certification would be inconsistent with public health, safety, or welfare

Certification deferral or withholding remains in effect pending final disposition of board investigations or civil/criminal court proceedings

Maximum deferral period is 120 days unless the underlying charge or complaint remains pending or is extended for good cause shown
