Exempts community gardens with on-site composting systems from obtaining DEP permits under the Solid Waste Management Act, New Jersey Statewide Mandatory Source Separation and Recycling Act, Air Pollution Control Act, and Water Pollution Control Act

Three conditions must be met for the exemption: the property must be used exclusively as a community garden, only vegetative waste generated by the garden may be composted, and all compost must be used on-site for the garden

DEP retains authority to require Water Pollution Control Act permits if a composting system is determined to be a significant discharger of pollutants

Defines "community garden" as any publicly or privately owned land maintained and cultivated as a garden by members of the surrounding community

Defines "vegetative waste" to include crop residues (stalks, hulls, leaves) and non-crop residues (grass clippings, tree parts, shrubbery, garden wastes)
