Residential substance use disorder treatment facilities must reserve at least 40% of beds for NJ FamilyCare (Medicaid/CHIP) eligible individuals as a condition of licensure

New facilities applying for initial licenses must achieve the 40% utilization rate within 12 months of licensure; existing facilities must comply within 12 months of their next license renewal

Department of Health will not issue or renew licenses for facilities that fail to document compliance with the minimum NJ FamilyCare utilization requirement

Applies to all residential facilities providing 24+ hours of substance use disorder treatment, including halfway houses, detoxification centers, extended care facilities, and short-term/long-term residential programs

Takes effect on the first day of the seventh month following enactment
