Allows inactive liquor licenses (unused for more than 3 renewal terms) to be transferred from municipalities with surplus licenses to "qualifying smart growth municipalities" that cannot issue new licenses due to the 1-per-3,000-population cap.

Purchasers must pay the sending municipality a transfer fee equal to 20 times the annual license renewal fee, distributed as: 25% to sending municipality, 25% to the ABC director, and 50% split among existing license holders in the receiving municipality.

Transferred licenses are permanently restricted to use within the same real estate development project and cannot be moved to other locations outside that project.

Repeals existing provisions (P.L.2007, c.351 sections 1 and 2) that allowed special permits for alcoholic beverage service in smart growth developments, replacing them with this license transfer system.

Takes effect on the first day of the third month after enactment, with the ABC director authorized to adopt implementing rules and regulations.
