Farm winery license holders may apply to the Director of Alcoholic Beverage Control for a waiver from the requirement to use at least 51% New Jersey-grown grapes or fruit during their first five years of operation

Waivers require the licensee to agree to meet the 51% New Jersey fruit requirement as soon as practicable and to not exceed their highest production year volume when using out-of-state fruit

The Director must decide on waiver applications within 15 days of receipt and may charge a reasonable application fee

Current law requires farm wineries to use at least 51% New Jersey-grown fruit for the first five years, then meet federal "New Jersey Wine" labeling requirements thereafter
