State-funded construction projects in New Jersey must use plastic construction materials (those containing more than 50% plastic by cost) with at least 10% postconsumer recycled content starting one year after enactment, increasing to 15% after two years.

The requirements apply to construction projects carried out by State, county, or municipal governmental entities that receive any State funding for construction, reconstruction, rehabilitation, or improvement of buildings, structures, roads, parks, and infrastructure.

Exemptions are provided when compliant materials would increase overall project costs by 25% or more, or when materials meeting the recycled content requirements do not exist for the intended application or are unavailable in sufficient quantities.

The Commissioner of Environmental Protection is authorized to adopt rules and regulations to implement the requirements.

The bill takes effect immediately upon enactment, with the recycled content requirements beginning one year later.
