Grants the New Jersey Board of Public Utilities (BPU) sole state authority to approve sites for small modular reactors (SMRs), defined as nuclear fission reactors with capacity of 300 megawatts or less that require U.S. Nuclear Regulatory Commission licensing.

Restricts SMR site approval to municipalities where nuclear energy facilities have previously been constructed, with BPU approval superseding any conflicting municipal or county decisions.

Authorizes SMR operators to store spent nuclear fuel on-site until a national high-level radioactive waste repository is developed under the federal Nuclear Waste Policy Act of 1982.

Requires the BPU and New Jersey Economic Development Authority to develop a financial incentive program for SMR construction within one year of enactment.

Preserves existing regulatory requirements including the State Uniform Construction Code, Radiation Protection Act, air and water pollution control laws, and Coastal Area Facility Review Act.
