NJ S72

Prohibits New Jersey Transit from making major alterations, renovations, or additions to rail yards located within the CAFRA coastal area, from which water flows into the Barnegat Bay Estuary watershed or EPA priority wetlands, and within 1,000 feet of freshwater wetlands, coastal wetlands, or tidal water bodies.

Requires express written authorization from the Governor after consultation with the NJ Department of Environmental Protection and US EPA for any exceptions to the prohibition.

NJ Transit must first obtain all applicable federal, state, county, and local permits before the Governor will consider any authorization request; the Governor may refuse authorization for any reason.

"Major alterations" include facility lighting, additional track, fuel canopy construction, fuel tanks, compressor houses, and other improvements as determined by DEP through rulemaking with public hearings.

Takes effect immediately and applies retroactively to any rail yard project for which permit applications were submitted to DEP after March 31, 2022.
