Municipalities, counties, school districts, and political subdivisions operating under New Jersey's civil service system (Title 11A) may withdraw by ordinance, resolution, or referendum.

Rescission takes effect six months after final adoption, with certification required to the Secretary of State and Civil Service Commission.

If a governing body rejects a rescission proposal, no new vote on withdrawal may occur for at least five years.

Entities that withdraw cannot readopt civil service provisions for at least five years and may only readopt once.

Current employees retain their civil service tenure, benefits, and protections after withdrawal; employees hired after rescission are not eligible for civil service.
