School districts in New Jersey would be required to obtain written permission from a parent or legal guardian before administering student health surveys, replacing the current notification-only requirement.

Surveys covered include those addressing alcohol, tobacco, drugs, and vaping use; sexual behavior and attitudes; behaviors contributing to injuries or violence; and physical activity and nutrition-related behaviors.

Permission forms must be delivered at least two weeks before survey administration via regular mail, electronic mail, or written acknowledgment form sent home with the student.

The bill removes the current provision stating that failure to respond indicates approval of participation, shifting from an opt-out to an opt-in consent model.

Survey results continue to be submitted to the Department of Education and Department of Health for public health initiatives, and districts violating these requirements face monetary penalties determined by the commissioner.
