New Jersey Senate condemns EPA rule 91 F.R. 7686, adopted February 18, 2026, which rescinded the 2009 greenhouse gas endangerment finding and repealed all GHG emission standards for light-duty, medium-duty, and heavy-duty vehicles and engines under the Clean Air Act.

Resolution argues the EPA rule contradicts the Supreme Court's 2007 Massachusetts v. EPA decision affirming EPA authority to regulate vehicle GHG emissions that endanger public health.

EPA acknowledged in its own rule adoption that repealing motor vehicle emission standards would result in a net societal cost of $260-$350 billion through 2055.

Transportation sector is identified as the largest source of greenhouse gas emissions in both New Jersey and the United States.

Copies of the resolution will be transmitted to the President of the United States, the EPA Administrator, and New Jersey's Commissioner of Environmental Protection.
