Law enforcement officers and Department of Transportation employees are authorized to move motor vehicles, cargo, or debris from roadways or highway rights of way when they constitute an immediate public safety hazard

The state, counties, municipalities, law enforcement officers, DOT employees, and anyone acting under their direction are granted immunity from liability for any damage caused during hazard removal

"Law enforcement officer" is defined to include state police, municipal police, county sheriffs, deputy sheriffs, public safety aides, and other state employees authorized to enforce criminal statutes

Existing law requiring drivers to move disabled vehicles off traveled portions of highways when practicable remains in effect, with drivers required to maximize passage width for other vehicles when removal is not possible
