Native American applicants may request a distinguishing mark on their driver's license or identification card designating them as Native American, with the specific format to be determined by the Motor Vehicle Division

The distinguishing mark cannot identify a specific Indian nation, tribe, or pueblo, nor include personal tribal membership information submitted during the application process

Applicants must submit one of four acceptable documents: an enhanced tribal card, a tribal identification card, a tribal certificate of Indian blood, or a tribal or Bureau of Indian Affairs affidavit of birth

Amends Section 66-5-10 (driver's licenses) and Section 66-5-401 (identification cards) of the NMSA 1978

Effective date is October 1, 2026
