Owners or operators of produced water facilities must acquire and maintain insurance before receiving state permits for treatment, reuse, discharge, or transport of produced water

Insurance policies must be issued by an insurer authorized to do business in New Mexico and cover the full reasonably foreseeable costs of spill response, cleanup, remediation, reclamation, long-term monitoring, and public health impacts

Any person who exercises control over the production, treatment, use, reuse, discharge, disposal, sale, or transport of produced water is jointly and severally liable for damages to those harmed by such activities

Amends the existing Produced Water Act (Chapter 70, Article 13 NMSA 1978)
