Health insurance premium surtax distributions to the Health Care Affordability Fund set at 55% from September 1, 2025 to September 1, 2027, increasing to 80% from September 2027 to September 2028, and 95% beginning September 1, 2028

Behavioral Health Program Fund receives 5% of health insurance premium surtax net receipts beginning September 1, 2028

Unexpended balances in the Behavioral Health Program Fund must revert to the Health Care Affordability Fund at the end of each fiscal year

Behavioral Health Program Fund may be used for mental health and substance misuse treatment, workforce and infrastructure supports, federal matching funds, compliance costs, and regional behavioral health plan implementation

All distributions cease if the health insurance premium surtax rate is reduced under Section 7-40-3 NMSA 1978
