Utilities abandoning qualifying generating facilities become ineligible to recover energy transition costs through financing orders if they invest in, construct, acquire, or operate new natural gas resources

Amends Section 62-18-4 NMSA 1978 (Energy Transition Act of 2019) to add new Subsection G creating this restriction

Utilities blocked from energy transition cost recovery under this provision cannot use the alternative recovery pathway under the Public Utility Act that remains available to other utilities

Energy transition costs eligible for recovery through bond financing include severance pay, job training for displaced workers, plant decommissioning, and mine reclamation costs
