Creates the crime of unlawful use of an unmanned aircraft (drone) for capturing images of persons, private property, or critical infrastructure with intent to conduct surveillance, punishable as a misdemeanor or fourth degree felony if images are used in a felony or involve confidential information

Establishes a separate fourth degree felony for operating drones near critical infrastructure facilities in ways that interfere with operations, cause disturbance, or make contact with the facility or persons on premises

Defines critical infrastructure broadly to include communications networks, electric systems, natural gas and oil pipelines, water pipelines, correctional facilities, National Guard/military installations, and municipal airports

Exempts drone use conducted with consent, by government agencies, for legitimate commercial purposes compliant with FAA rules, pursuant to warrants/court orders, for academic research, by licensed surveyors/engineers, or by insurance companies for underwriting and claims

Defines "image" expansively to include captures of sound waves, thermal, infrared, ultraviolet, visible light, electromagnetic waves, odor, or other conditions on property or individuals
