Creates a new exception to governmental immunity under New Mexico's Tort Claims Act (Section 41-4-12.1) allowing lawsuits against the Children, Youth and Families Department (CYFD)

Waives immunity when a child in CYFD custody is abused due to negligence of department employees acting within the scope of their duties

Applies specifically to children who were removed from their homes because they were abused or neglected by their parents under the Abuse and Neglect Act

Amends Section 41-4-4 NMSA 1978 to expand the list of immunity exceptions from Sections 41-4-5 through 41-4-12 to include the new Section 41-4-12.1
