NM SB39

Establishes Public Regulation Commission authority to approve and regulate microgrids (electric systems with at least 20 megawatts of self-source generation capacity that can operate independently or connected to the grid)

Creates a microgrid renewable portfolio standard requiring 40% renewable energy for new microgrids starting May 20, 2026, increasing to 50% by January 1, 2030, 80% by January 1, 2040, and 100% zero carbon by January 1, 2045

Prohibits the commission from approving utility acquisitions of self-source generation if it would increase rates or adversely affect ratepayers, and prohibits microgrid power purchases that would raise existing customer rates

Requires microgrid owners to file annual compliance reports beginning July 1, 2027, detailing total energy generation, renewable energy by technology type, compliance status, and water use

Authorizes the commission to collect fees from microgrid owners and operators to cover oversight costs and to enter microgrid premises during reasonable hours for inspections
