Creates a food recovery and composting program within the Department of Environment to provide grants, education, and outreach for food recovery, composting, and organic waste reduction statewide, with grants available to municipalities, counties, tribal governments, land grant-mercedes, acequias, and solid waste authorities beginning January 1, 2027

Establishes a 15-member Food Recovery and Composting Advisory Group appointed by the Secretary of Environment, including representatives from state agencies, local governments, tribal nations, and organizations specializing in waste reduction, serving two-year volunteer terms

Imposes a $3.00 per ton surcharge on solid waste processed at solid waste facilities, with a reduced rate of $2.00 per ton for facilities that operate on-site composting operations

Creates a nonreverting Food Recovery and Composting Fund in the state treasury to receive surcharge revenues, with no more than 15% of appropriated funds allowed for contracted services or education/outreach programming

Effective date is July 1, 2026, with the Taxation and Revenue Department authorized to retain up to 3% of collected surcharge amounts for administrative costs
