Creates the Office of Special Education within the Public Education Department, headed by a Deputy Secretary for Special Education appointed based on education and experience in special education

Removes gifted students from the definition of special education, separating gifted programs from special education services while maintaining state funding only for department-approved gifted programs serving students who meet eligibility criteria

Requires development of a statewide uniform online system for Individualized Education Programs (IEPs) that all school districts must use to document services, monitor progress, and ensure compliance with federal IDEA timelines

Mandates quarterly consultation between the Office and a committee of school district superintendents and charter school administrators to implement continuous improvement measures for students with disabilities

Effective date is July 1, 2026
