School districts must prohibit discrimination against library resources based on disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, family composition, religion, age, national origin, tribal affiliation, or ancestry

Only students enrolled at a school or their parents may request removal, restriction, or discontinuation of a library resource, and each resource may only be considered for removal once every two years at minimum

Library resources must be reviewed as a whole when considered for removal, and final determinations must be in writing, publicly available, and explain the standards applied

Local school boards must establish written policies for library management and submit them to the department for approval by September 1, 2026, with policies required to comply with First Amendment and New Mexico constitutional free speech protections

Library staff members are protected from termination, demotion, discipline, or retaliation for refusing to remove materials before a final determination is made or for making good-faith decisions that comply with the law
