Public bodies in New Mexico must establish policies governing employee use of artificial intelligence, automated decision tools, and technology resources, with specific security procedures for protecting nonpublic data

Human employees are required to make all final consequential decisions regardless of AI or automated tool recommendations, covering areas including education enrollment, employment, financial services, housing, health care, insurance, and legal services

Employees are prohibited from using AI and technology resources to intentionally override or bypass security or system integrity procedures, except during authorized security testing

Executive, judicial, and legislative agencies must make their AI and technology policies publicly available upon request

Public bodies must train employees on cybersecurity policies, appropriate use of AI tools, and automated decision-making; effective date is July 1, 2026
