Adds nuclear energy (fission and fusion) to the definition of "renewable energy resource" under both the Rural Electric Cooperative Act and the Renewable Energy Act

Nuclear facilities must not emit carbon dioxide or other greenhouse gases during electricity generation to qualify

Removes nuclear energy from the list of excluded energy sources, allowing it to count toward the renewable portfolio standard for public utilities and rural electric cooperatives

Applies to both public utilities certified by the Public Regulation Commission and rural electric cooperatives in New Mexico

Amends Section 62-15-37 NMSA 1978 (Rural Electric Cooperative Act) and Section 62-16-3 NMSA 1978 (Renewable Energy Act)
