Requests the Governor of New Mexico to submit an advance election to participate in the federal Education Freedom Tax Credit program established July 4, 2025 under 26 U.S.C. Section 25F

Starting in 2027, taxpayers can claim up to $1,700 in dollar-for-dollar federal tax credits for donations to nonprofit scholarship granting organizations that fund K-12 scholarships for low-income families and students with special needs

Scholarships can cover tuition, fees, tutoring, special needs services, books, supplies, and equipment at public, private, or religious schools

States must formally opt in through gubernatorial action for their scholarship granting organizations to receive tax-credit-eligible donations; non-participating states risk losing charitable contributions to participating states

National polls cited show approximately 70% of registered voters support state participation, with nearly 80% of parents with school-age children likely to apply for scholarships if available
