Proposes amending Article 12, Section 6 of the New Mexico Constitution to replace the governor-appointed Secretary of Public Education with an appointed State Board of Education consisting of nine members who are New Mexico residents with public education knowledge and experience

State Board of Education would determine public school policy and have control, management, and financial direction of all public schools, and would appoint a "superintendent of public instruction" (a qualified, licensed New Mexico educational administrator) to direct the Public Education Department

Retains the elected Public Education Commission with 10 members serving staggered four-year terms, which would continue as the chartering authority for state-chartered charter schools

Current Secretary of Public Education would serve as superintendent of public instruction until the new board appoints a replacement

Constitutional amendment must be submitted to voters for approval at the next general election or a special election called for that purpose
