NM SJR6

Proposes amending Article 2, Section 13 of the New Mexico Constitution to allow courts to deny bail for persons charged with felonies who pose an unreasonable risk to public safety or are an unreasonable flight risk

Removes the current requirement that prosecutors prove "by clear and convincing evidence that no release conditions will reasonably protect" the community, replacing it with a lower standard of proving "unreasonable risk"

Preserves protections preventing detention solely due to financial inability to post bond for persons who are not unreasonable safety or flight risks

Requires appeals from orders denying bail to be given preference over all other matters

Must be submitted to voters for approval at the next general election or a special election called for that purpose
