Prohibits directly or indirectly threatening or intimidating candidates for public office when the threat communicates intent to cause bodily injury to the candidate or their family members, or physical damage to their property, and places the recipient in reasonable fear the threat will be carried out.

First offense constitutes a misdemeanor; second or subsequent offenses constitute a gross misdemeanor.

Candidates who believe they are subject to prohibited threats may notify the Secretary of State in writing, triggering a mandatory investigation.

Secretary of State must refer matters to the Attorney General for potential prosecution if reasonable suspicion of a violation exists, and must issue a written report to the candidate detailing the investigation results.

Explicitly protects constitutionally protected free speech, including political hyperbole.
