Injured construction workers would receive workers' compensation based on the greater of their average monthly wage or average monthly prevailing wage (the public works wage rate for their region and trade), regardless of whether they were actually employed on a public works project

The Administrator of the Division of Industrial Relations must establish regulations for calculating average monthly prevailing wage using the worker's historical hours (typically 12 weeks, or up to 1 year for union workers employed through hiring halls)

Compensation changes apply to permanent total disability, temporary total disability, permanent partial disability, death benefits, and lump-sum payments for construction workers injured on or after October 1, 2025

Construction workers or employers may request a hearing to recalculate the average monthly prevailing wage if calculated improperly, with insurers required to pay underpayment amounts as a lump sum

Provisions apply prospectively only to claims open or filed on or after October 1, 2025, with no effect on local government but a fiscal effect on the state
