Prohibits governmental entities and government-funded entities operating mental health facilities or prisons from using federally reviewed products (patented and FDA/USDA-approved items) in ways contrary to manufacturer terms, written instructions, or approved uses

Allows covered entities to use products in non-conforming ways after providing 30-day written notice to patent holders and manufacturers, unless those parties transmit a written objection

Requires covered entities to immediately cease non-conforming product use upon receiving a written objection from patent holders, manufacturers, or distributors

Permits non-conforming use without notice requirements if the resident receiving the product provides informed consent

Applies to entities receiving 50% or more of their operating budget from government sources; effective July 1, 2025
