Places burden of proof on regulatory bodies to prove by preponderance of evidence that issuing the license would pose a "direct, substantial and unmitigatable risk to public health or safety"; prior arrests alone are insufficient to meet this burden

Courts must order the regulatory body to issue the license if the burden of proof is not met; exempts licenses issued by the State Contractors' Board
