Courts may allow minor or vulnerable witnesses to use facility dogs for emotional support during testimony in criminal proceedings involving violent or sexual offenses and in abuse or neglect proceedings

Parties must file a motion demonstrating the dog and handler are certified by Assistance Dogs International or similar organization, the dog has adequate liability insurance, and the dog's presence will assist the witness without prejudicing the defendant

Courts must keep facility dogs out of jury view to the greatest extent practicable and provide cautionary jury instructions upon request to mitigate potential prejudice

Counties and municipalities must permit court-approved facility dogs to enter courthouses and other government buildings for witness preparation, but retain discretion to exclude dogs for misconduct after entry

Counties and municipalities receive immunity from liability for any injury or loss caused by the presence or conduct of facility dogs on government property
