County governing bodies may engage in good faith discussions with tribal governments to enter into joint or cooperative agreements for governmental services where tribal land is located partially or wholly within the county

Agreements with tribal governments must be conditional interlocal agreements that do not require the tribe to waive sovereign immunity

Counties may terminate agreements with 90 days' written notice if: the tribal government is more than 60 days delinquent on financial obligations, fails to respond to written demands for more than 90 days, prevents county entry onto tribal land to perform services, or enters a conflicting subsequent agreement

Water authorities, water districts, and water reclamation districts are excluded from the definition of county agencies for purposes of these agreements
