Owners of leased residential solar systems must file disposal plans with the Division of Environmental Protection, including provisions for reuse, refurbishment, or recycling of solar panels with a minimum 90% material recovery rate by weight.

Facilities recycling distributed generation systems or utility-scale solar projects must submit annual reports by March 1 detailing total materials received, recycled, and recovery rates.

Lease agreements for distributed generation systems must include a description of the lessor's obligations for disposing of the system according to the filed plan.

Surplus asset retirement plans for utility-scale solar projects (70+ megawatts) must include decommissioning details, land restoration plans, cost estimates, recycling provisions, and funding descriptions.

Provisions for utility-scale solar retirement plans take effect October 1, 2025; disposal plan and reporting requirements for distributed generation systems take effect January 1, 2028.
