Broadband providers must enter into agreements with local governments to access public rights-of-way starting July 1, 2026, with local governments required to execute these agreements in a nondiscriminatory manner.

Compensation paid by broadband providers to local governments is capped at 2% of annual gross revenue derived from broadband service or infrastructure access within that jurisdiction.

The definition of "broadband provider" excludes video service providers, basic network service providers, and commercial mobile radio service providers already regulated under other statutes.

Local governments may begin negotiating agreements upon passage of the act but cannot suspend or revoke a broadband provider's right-of-way access for lack of an agreement until after July 1, 2026.

Fees imposed on broadband providers under these agreements are exempt from existing statutory caps on local government business license fee increases.
