Wholesale electricity generation facilities over 1 megawatt that become operational on or after January 1, 2026, within a rural electric utility's service territory must purchase station power (energy for operations, maintenance, and repair) from that rural utility unless otherwise agreed in writing.

Facilities must comply with all rules, rates, and policies of the rural utility's governing board and allow the utility to install or certify meters for accurate monthly energy readings.

Rural utilities may charge wholesale generation facilities retail rates comparable to those charged to other customers with similar load characteristics in their territory.

If a wholesale facility receives station power from a different provider, that provider must remit to the rural utility an amount equal to what the facility would have paid the rural utility.

Applies to rural electric utilities defined as cooperative associations, nonprofit corporations serving members, or municipal utilities serving fewer than 100,000 retail meters; excludes geothermal facility parasitic loads from the station power definition.
